What is the overtime rate for salaried employees?
Salaried employees earning under $684/week ($35,568/year) are entitled to overtime under FLSA. For those above the threshold, it depends on their job duties. Non-exempt salaried workers use their regular rate: annual salary ÷ 52 weeks ÷ 40 hours.
Can my employer give comp time instead of overtime pay?
Private sector employers generally cannot substitute comp time for overtime pay under federal law. Government employees may receive comp time. Some states have additional restrictions.
