No Tax on Tips Explained: Who Qualifies & How Much You Save (2026)

March 1, 2026 · 5 min read

The "No Tax on Tips" proposal has been one of the most discussed tax policy ideas of 2025-2026. For the estimated 4 million tipped workers in the US, it could mean keeping an extra $1,500 to $4,000 per year. Here is everything you need to know.

What Is the No Tax on Tips Proposal?

The proposal would exempt tip income from federal income tax, up to $25,000 per year. Tips above $25,000 would still be taxed normally. Workers earning over approximately $160,000 in wages would not qualify for the full exemption.

Some versions also include exemption from FICA taxes (Social Security and Medicare "” currently 7.65%) on tip income, which would add significant additional savings.

Who Qualifies?

The exemption would apply to workers in traditionally tipped occupations, which the IRS typically defines as:

  • Restaurant servers and bartenders
  • Hotel staff (valets, bellhops, housekeeping)
  • Hair stylists, barbers, nail technicians
  • Casino dealers
  • Taxi and rideshare drivers who receive tips
  • Delivery workers who receive tips

Salaried workers, managers, and workers who receive tips incidentally (not as a primary part of compensation) would likely not qualify.

Current Legislative Status

As of March 2026, the No Tax on Tips proposal has been introduced in Congress but has not been signed into law. The proposal has bipartisan support in concept but debates continue over the income cap, definition of qualifying workers, and whether FICA is included.

Check the official IRS website (irs.gov) and Congress.gov for the most current status. Do not adjust your tax withholding based on this exemption until it is officially enacted.
